Tessera PBS Privacy Policy & Participant Information Collection Statement

Tessera PBS Pty Ltd (“Tessera PBS”, “we”, “our”, or “us”) respects your privacy and is committed to protecting the personal and sensitive information you share with us.

This Privacy Policy explains how we collect, use, store, disclose, and protect information collected through our website, referral forms, communication channels, and Positive Behaviour Support services.

Tessera PBS manages personal information in accordance with the Privacy Act 1988 (Cth), Australian Privacy Principles (APPs), and applicable NDIS Quality and Safeguards requirements.

Tessera PBS collects personal and sensitive information necessary to provide safe, effective, person-centred Positive Behaviour Support services.

Information collected may include:

• participant details and contact information
• parent, guardian, nominee, or authorised representative details
• referral information
• NDIS details, plan information, and funding arrangements
• disability, developmental, medical, and mental health information
• medication and relevant health information
• behaviour support information
• restrictive practice information (where applicable)
• assessments, observations, behavioural data, and progress information
• information from families, carers, support workers, schools, allied health professionals, medical practitioners, and service providers
• feedback, complaints, and service information
• reports, Behaviour Support Plans, correspondence, and progress notes

Information relating to participants receiving NDIS-funded supports may include protected information under the National Disability Insurance Scheme Act 2013.

Tessera PBS collects, uses, and discloses this information only where required for service delivery, consent has been provided, or where authorised or required by law.

Tessera PBS may also collect personal information relating to employees, contractors, students, or prospective workers for:

• recruitment and onboarding
• worker screening and compliance
• qualifications and training records
• supervision and performance management
• payroll and administration
• work health and safety obligations

Only information reasonably required for service delivery, operations, and compliance obligations will be collected.

Information may be collected when you:

• submit a website enquiry or referral form
• contact Tessera PBS by phone, email, or online systems
• complete intake, consent, or assessment documents
• participate in assessments, observations, meetings, or service delivery
• provide reports or supporting information

If you provide information about another person, you confirm that you have appropriate authority or consent to share that information.

Information is collected for the purpose of providing quality Positive Behaviour Support services.

Information allows Tessera PBS to:

• understand strengths, needs, goals, and support requirements
• complete Functional Behaviour Assessments (FBA)
• develop Interim and Comprehensive Behaviour Support Plans
• provide recommendations and capacity-building support
• support implementation across environments
• provide psychoeducation and support to participants and support networks
• meet NDIS documentation, reporting, and safeguarding requirements

If relevant information is not provided, Tessera PBS may be unable to provide appropriate or complete services.


4. How Your Information May Be Used

Information may be used for:

• Positive Behaviour Support service delivery
• assessment, planning, and report writing
• communication regarding supports
• scheduling and administration
• billing you, your plan manager, the NDIA, or other funding bodies
• maintaining records
• quality improvement and compliance activities

Where information is used for quality improvement, supervision, training, reporting, or service review purposes, identifying information will be removed where appropriate.


5. Sharing Your Information

Tessera PBS respects confidentiality and only shares information when necessary and appropriate.

With consent, information may be shared with:

• family members, nominees, guardians, or authorised representatives
• Support Coordinators and Recovery Coaches
• allied health professionals
• medical practitioners
• schools and education providers
• SIL/SDA providers
• support workers and care teams
• other providers involved in your support

Information sharing supports safe, coordinated, and consistent services.

Tessera PBS does not sell or rent personal information to third parties.


6. NDIS Reporting, Safeguarding and Legal Requirements

There may be circumstances where information is required to be disclosed without further consent, including:

• where required or authorised by law
• serious risk of harm or safety concerns
• mandatory reporting obligations
• NDIS Quality and Safeguards Commission requirements
• behaviour support and restrictive practice reporting obligations
• quality, safeguarding, or audit requirements

Where appropriate, Tessera PBS will inform you about information sharing.

Participants may choose whether they wish to participate in external audits or quality improvement activities unless otherwise required.

When accessing the Tessera PBS website, limited technical information may be collected, including:

Participant records are retained in accordance with applicable legal, professional, administrative, and NDIS requirements.

When information is no longer required, it will be securely destroyed or de-identified where appropriate.


12. Accessing and Correcting Information

You may request access to personal information held about you.

You may request corrections if information is inaccurate, incomplete, or outdated.

Identification may be required before information is released.


13. Children and Authorised Representatives

Where services are provided to children or participants requiring decision-making support, Tessera PBS may communicate with parents, guardians, nominees, or authorised representatives.

Where possible, participants are supported to understand and participate in decisions regarding their information and supports.


14. Confidentiality

All information shared with Tessera PBS is treated confidentially and respectfully.

Personal experiences, disability information, behaviour support needs, and family circumstances will be handled with dignity and care.


15. Overseas Disclosure

Tessera PBS does not intentionally disclose personal information overseas unless required, authorised, or consented to.

Where technology providers are used, reasonable steps are taken to ensure appropriate privacy safeguards.


16. Photos, Videos and Media Consent

Tessera PBS will not use photographs, videos, testimonials, or identifying information for promotional, educational, or marketing purposes without separate written consent.

Media consent is optional and may be withdrawn at any time.


17. Privacy Concerns or Complaints

Privacy concerns can be raised directly with Tessera PBS.

Concerns will be reviewed respectfully and responded to within a reasonable timeframe.

By submitting a referral form, providing information, or engaging with Tessera PBS, I acknowledge that:

• I understand why information is collected and how it may be used
• I consent to Tessera PBS collecting and using information for Positive Behaviour Support services
• I understand relevant information may be shared with professionals involved in my support, with consent or where legally required
• I understand I may request access to or correction of my information
• I understand consent may be withdrawn or updated at any time


19. Changes to This Policy

Tessera PBS may update this Privacy Policy from time to time.

The current version will be available on the Tessera PBS website.
